USA H1B Visa

Under the Immigration and Nationality Act, people looking for employment in United States need an H1-B Visa. H1-B visas are non-immigrant visas that allow U.S. employers to hire foreign nationals in specialty occupations for a specified period. 

Documents Required by the Employer/Petitioner

  • Copy of offer
  • Letter Copy of Employer-Employee Agreement
  • Copy of In-House project details (if the employee will be working at company's location)
  • Copy of Master Service Agreement (if the employee will be working at an off-site location)
  • Copy of end client letter (if the employee will be working at an off-site location)
  • Copy of vendor letter (if the employee will be working at an off-site location)
  • Article of incorporation, business license and website pages

Documents Required by the Employee/Beneficiary

  • Academic Certificates with transcripts
  • Copy of educational credential evaluation report (if acquired higher education from a foreign Institute)
  • Copy of the training/diploma certificates, if any
  • Copy of any awards, appraisals, achievements or certifications, if any
  • Copy of the recent updated resume
  • Copy of the previous work experience letters All I-797 (prior notice/receipt of approvals) Copy of I-94 (Arrival-Departure record)
  • Copy of the passport
  • I-20 documents in case you were in USA on student visa

Processing Time

General processing times for H-1B status can be anywhere from two to six months, sometimes longer. If the department is in a hurry to get the H-1B petition approved, it is possible to request premium processing for an H-1B case which will cost  additional $2,500.
